Terms and Conditions for AidMart

- Introduction and Acceptance
1.1. This website, AidMart(https://aidmart.co.za), is an online marketplace and donation platform operated by Envion PTY LTD, a company registered in the Republic of South Africa (“we”, “us”, “our”, “AidMart”).
1.2. These Terms and Conditions (“Terms”) govern your access to and use of the AidMart website, services, and platform. By accessing or using AidMart, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use this platform.
1.3. These Terms incorporate by reference our other key policies:
- Privacy Policy– Details how we collect, use, and protect your personal information.
- Returns and Refunds Policy– Outlines the platform process for returns.
- Shipping Policy– Details general delivery expectations.
- Cookie Policy– Explains our use of cookies.
- Disclaimer– Contains critical limitations of liability and warnings.
- Nature of the AidMart Platform
2.1. AidMart is a Facilitator, Not a Seller or Donor.AidMart operates as a digital platform or intermediary. Our sole purpose is to provide a venue where:
- Registered Third-Party Suppliers (“Vendors”)can list and sell assistive technology and daily living equipment.
- Buyers can discover, evaluate, and purchase products from these Vendors.
- Donors can list used equipment in fair condition for donation to vetted community organisations or individuals (“Recipients”).
2.2. Direct Contractual Relationships. AidMart is not a party to any transaction between users of the platform.
- A contract of sale is formed directly between a Buyer and a Vendor upon the Vendor’s acceptance of the Buyer’s order.
- A donation is a transaction facilitated directly between a Donor and a Recipient.
2.3. Our Role. AidMart’s role is limited to hosting the platform, facilitating connections, providing payment processing services as an agent, and establishing these general rules of use. We do not own, warehouse, sell, or take ownership of any products listed.
- User Accounts and Responsibilities
3.1. To use certain features, you must register an account. You are responsible for maintaining the confidentiality of your account and password and for all activities under your account.
3.2. You agree to provide accurate, current, and complete information and to update it promptly.
3.3. Vendor-Specific Obligations: Vendors are solely responsible for the accuracy, quality, and legality of their product listings, for fulfilling orders, and for providing their own customer service, warranties, and return policies (which must be POPIA-compliant and provided to Buyers).
3.4. Donation-Specific Obligations:
- Donors must accurately and honestly describe the condition of the donated item. AidMart does not verify condition or functionality.
- By using the donation service, all parties agree that items are transferred “AS-IS” and “WITH ALL FAULTS”. AidMart expressly disclaims all responsibility for the condition, safety, or fitness for purpose of any donated item.
- The Donor and Recipient are solely responsible for coordinating the logistics, safety, and terms of the item transfer.
- Orders, Pricing, and Financial Terms
4.1. All product listings, descriptions, prices, and shipping costs are provided by and are the responsibility of the Vendor. AidMart does not warrant the accuracy of this information.
4.2. You place an offer to purchase when you check out. The Vendor may accept or reject this offer. The sales contract exists solely between you and the Vendor.
4.3. Prices are in South African Rand (ZAR) and include VAT where applicable.
4.4. AidMart facilitates payment processing. Your payment obligation to the Vendor is discharged upon successful processing. Title to goods passes as per the agreement between Buyer and Vendor. - Shipping, Delivery, and Risk
5.1. Shipping methods, costs, and timelines are set by the Vendor. The Shipping Policy provides general expectations, but specific terms are the Vendor’s responsibility.
5.2. Risk of loss or damage to products generally passes to the Buyer upon delivery to the carrier, as determined by the Vendor’s chosen shipping terms.
5.3. For international orders, the Buyer is the importer of record and solely responsible for all duties, taxes, and customs compliance. - Returns, Refunds, and Disputes
6.1. Vendor-Managed Policies: Returns, refunds, and warranties are governed primarily by the individual policy of the Vendor from whom the purchase was made. AidMart’s Returns and Refunds Policy outline the platform process for initiating a request, but the final decision, condition assessment, and refund issuance are the Vendor’s responsibility.
6.2. Statutory Rights: Your rights under the South African Consumer Protection Act (CPA) are not diminished. However, any claims regarding defective goods should be directed to the Vendor in the first instance.
6.3. Platform Dispute Facilitation: AidMart may, at its discretion, provide a channel to facilitate communication in transaction disputes but is under no obligation to adjudicate or become involved. Our liability is limited as set out in Clause 8. - Intellectual Property and Content
7.1. The AidMart platform, its design, and our proprietary content are owned by Envion PTY LTD.
7.2. Vendors retain ownership of intellectual property in their product listings but grant AidMart a license to display them on the platform.
7.3. You may not misuse, copy, or extract data from the platform. - Disclaimers and Limitation of Liability
8.1. “AS-IS” Platform: The AidMart platform and services are provided on an “as-is” and “as-available” basis. We disclaim all warranties, express or implied.
8.2. No Verification of Listings: AidMart does not verify, endorse, or guarantee the quality, safety, authenticity, or legality of any items listed, whether for sale or donation. We do not warrant that product descriptions are accurate.
8.3. Limitation of Liability: To the fullest extent permitted by South African law, neither Envion PTY LTD nor its directors, employees, or agents shall be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform or any transaction conducted through it.
8.4. Cap on Liability: In any event, our total aggregate liability to you for any claims shall be limited to the total fees we earned from the specific transaction in question, or ZAR 100.00, whichever is greater.
8.5. Third-Party Interactions: Your interactions with Vendors, Donors, and Recipients are solely between you and them. You release AidMart from any claims related to transactions or donated items. - Privacy
We process personal information as described in our Privacy Policy, in compliance with POPIA. Vendors, Donors, and Recipients are independent controllers for the personal data they receive through transactions and must handle it lawfully. - General Provisions
10.1. Governing Law: These Terms are governed by the laws of the Republic of South Africa.
10.2. Changes: We may modify these Terms. Continued use after changes constitutes acceptance.
